AmiCove Terms and Conditions & Privacy Policy

1. Age Restriction and Parental Responsibility

Age Requirement: The Service is strictly intended for users aged 18 or older. Individuals under 18 are prohibited from registering.

Parental Responsibility: If a parent or guardian permits a minor to access the Service through their device, the parent or guardian assumes full legal responsibility for all actions taken by the minor. AmiCove Limited disclaims all liability for interactions or purchases made by minors.

2. Virtual Assets (Hearts) Policy

No-Refund Policy: All purchases of Hearts are final. Hearts are digital tokens for use within the AmiCove ecosystem and do not possess real-world monetary value or legal tender status.

Non-Transferability: Hearts cannot be exchanged for cash, are non-transferable, and will be forfeited immediately if your account is terminated due to a violation of these Terms.

3. AI-Generated Content and Confidentiality

Disclaimer: AmiCove utilizes Artificial Intelligence for companionship. AI-generated responses do not constitute medical, psychological, or professional advice. AmiCove Limited is not liable for any psychological impact resulting from interactions.

Confidential Information: The Service is not a secure repository for sensitive information (e.g., banking credentials, ID numbers, or legal secrets). You are strictly prohibited from sharing sensitive information. Any such information shared is at your sole risk, and AmiCove Limited assumes no liability for its disclosure or misuse.

4. Normal Mode vs. Incognito Mode

Normal Mode: Chat history is recorded, processed, and stored to enhance personalization and enable cross-platform synchronization across your Web and Mobile Apps.

Incognito Mode: If you enable "Incognito Mode," your interaction data is not stored, will not be used for personalization, and will not be synchronized. You acknowledge that by using Incognito Mode, AmiCove will have no "memory" of these interactions, and they cannot be recovered.

5. Data Security and Sync

Sync Logic: Your data is synchronized via cloud servers. In cases of latency or state conflicts between your devices, the data stored on our central cloud servers shall be considered the authoritative version.

Encryption: We employ industry-standard encryption, including End-to-End Encryption (E2EE) protocols, to secure your chat data during transmission and storage.

6. Referral Fraud

The Referral Program is for genuine invitations. The use of bots, mass-registration, or fraudulent techniques to accumulate Hearts is prohibited and will result in immediate account termination and asset forfeiture.

7. Creator / Influencer Affiliate Program

Eligibility: Participation in the Creator Program is by invitation or approval only. AmiCove Limited reserves the right to accept, suspend, or terminate any creator partner at its sole discretion.

Commission Structure: Commissions are calculated on the net amount actually received by AmiCove from referred user top-ups processed through Stripe (excluding refunds and chargebacks):

• Tier 0 (default): 5% — available upon joining the program.
• Tier 1: 7% — requires a single qualifying video with at least 100,000 verified views, official platform Analytics screenshots, a 7-day observation period, and admin approval.
• Tier 2: 10% — requires Tier 1 status, a qualifying video with at least 250,000 verified views, official Analytics screenshots including follow-up proof after 14 days, a 14-day observation period, and admin approval. Tier upgrades must be sequential; Tier 2 cannot be granted without prior Tier 1 approval.

Attribution: Commissions apply to users who register through a creator's unique link (?c=slug or /r/slug) and remain attributed to that creator. All subsequent top-ups by an attributed user qualify for commission at the creator's then-current approved rate, unless attribution is voided for fraud or policy violation.

View Verification & Anti-Fraud: Creators must submit authentic screenshots from official platform analytics tools (e.g., TikTok Creator Center, YouTube Studio, Instagram Insights). AmiCove cross-validates claimed views against link clicks, signups, and purchase conversion. Purchased, bot, or artificially inflated views are prohibited. Confirmed fraud may result in tier downgrade, commission clawback, suspension, or termination.

Payouts: Minimum payout threshold is USD $50 per calendar month. Payouts are processed manually on or around the 15th of each month for the prior month's accrued commissions. Payment methods (e.g., PayPal or bank transfer) are arranged directly with approved creators.

Taxes: Creators are solely responsible for reporting and paying any taxes owed on commission income in their jurisdiction. AmiCove does not withhold taxes unless required by applicable law.

Final Determination: AmiCove has final authority over view counts, tier eligibility, fraud determinations, and commission calculations. Decisions following the review process are binding under these Terms.

8. Dispute Resolution and Governing Law

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region.

Mandatory Arbitration: Any dispute arising out of this Service shall be settled through mandatory mediation. If mediation fails, the dispute shall be finally resolved by arbitration administered by the Hong Kong International Arbitration Centre (HKIAC).

Waiver of Litigation: To the maximum extent permitted by law, you hereby waive any right to bring a lawsuit in a court of law. All disputes must be handled exclusively through the mediation and arbitration process.

Limitation of Liability: In no event shall AmiCove Limited or its affiliates be liable for any indirect, incidental, or consequential damages arising from the use of our Service, to the fullest extent permitted by Hong Kong law.
